Validate Your European Patent in Türkiye Before the 3-Month Deadline

The Problem

Your client holds a granted European Patent (kind code B1), but a granted EP does not automatically protect their invention in Türkiye. Türkiye is a contracting state to the European Patent Convention, which means the patent must be validated nationally for it to take effect.

The clock is strict. Validation in Türkiye must be requested within three months of the date the grant is mentioned in the European Patent Bulletin. The Turkish translation may follow within a further three months (six months in total) subject to a late fee. Miss the window and the patent has no effect in Türkiye.

There is a second requirement that foreign attorneys and applicants often discover late. A foreign applicant who has no residence and no place of business in Türkiye cannot file the validation directly. They must appoint a registered Turkish patent attorney to act on their behalf.
