What does it mean to validate a European Patent in Türkiye?
Türkiye is a contracting state to the European Patent Convention, but a granted European Patent (kind code B1) does not automatically take effect here. Validation is the national step that gives the granted EP the same effect as a Turkish patent, enforceable before the Turkish courts and the Turkish Patent and Trademark Office. Until the patent is validated in Türkiye, your client has no enforceable protection in this territory, even though the EP has been granted.
Why must a granted EP be validated nationally? Is it not already in force?
A granted European Patent is a bundle of national rights, not a single unitary right that covers every member state automatically. For the patent to have legal effect in Türkiye, it must be brought into force nationally through validation. If this step is missed, the invention is unprotected in Türkiye and a third party could use it locally without infringing any Turkish right, regardless of the EP grant.
What is the deadline to validate in Türkiye?
The validation must be requested within three months of the date the grant is mentioned in the European Patent Bulletin. This period runs from the bulletin date, not from when you receive any notice, so the safest course is to instruct your local Turkish attorney early. The required Turkish translation may follow within a further period after the request, subject to a late fee, but the request itself is governed by the three-month window. Why do we need a registered Turkish patent attorney to validate?
Under Turkish law, a foreign applicant or patent holder who has neither a residence nor a place of business in Türkiye must appoint a registered Turkish patent attorney to act before the Turkish Patent and Trademark Office. You cannot file the validation directly from abroad. This is a legal requirement, not a formality.
