EP Validation in Türkiye
How EP Validation in Türkiye Works
A step-by-step guide for foreign patent attorneys and applicants validating a granted European Patent in Türkiye, with the deadlines, requirements and process explained in plain legal English.
Türkiye is a contracting state to the European Patent Convention (EPC). Once the European Patent Office mentions the grant of a European patent in the European Patent Bulletin, that patent does not automatically take effect in Türkiye. To obtain enforceable protection in Türkiye, the granted patent must be validated. Validation gives the European patent the same effect as a national Turkish patent, enforceable before the Turkish courts and the Turkish Patent and Trademark Office.
The sections below set out exactly how the process works, the deadlines that govern it, and what we need from you to act as your local Turkish attorney.
The 3-Month Deadline
The single most important date is the mention of the grant in the European Patent Bulletin. From that date, the granted European patent (kind code B1) must be validated in Türkiye within 3 months. This is a strict statutory deadline. If the request to validate is not filed within this window, the patent does not take effect in Türkiye and the protection in this territory is lost.
Because the period runs from the bulletin date rather than from the date you receive any notification, we recommend engaging your local Turkish attorney as early as possible, ideally before grant is published, so that the file is ready and nothing depends on postal or administrative delay.
The Translation Requirement
Validation in Türkiye requires a Turkish translation of the granted patent. The translation must be accurate and consistent with the granted text, because the Turkish version defines the scope of protection that can be enforced locally.
The translation does not have to be filed at the very same moment as the validation request. The Turkish translation may be filed within a further 3 months after the initial deadline, giving a total window of 6 months from the mention of the grant. Filing the translation in this additional period requires payment of a late fee. We prepare and manage the translation through qualified technical translators and review it for legal and technical consistency before filing.
Official Fees and Costs
The overall cost of validation is made up of official fees payable to the Turkish Patent and Trademark Office plus professional and translation fees. Official fees are not a single flat figure: they depend on factors such as the number of claims and the number of pages to be translated, since translation volume is the main cost driver.
For this reason we do not quote a generic price. After you send us the basic details of the patent, we provide a fixed, transparent quote covering official fees, translation and our professional fee, so that you and your client know the full cost before any work begins. There are no hidden charges.
Why a Local Turkish Attorney Is Mandatory
Under Turkish law, a foreign applicant who has neither a residence nor a place of business in Türkiye must appoint a registered Turkish patent attorney to act before the Turkish Patent and Trademark Office. You cannot validate directly from abroad without local representation. This is not a formality we recommend; it is a legal requirement for validation to proceed.
This is the core reason to engage Validation Türkiye. We are registered Turkish patent and trademark attorneys and European Patent Attorneys, and we act as your mandatory local attorney of record. We work peer to peer with foreign counsel as your local co-counsel, handling the Turkish-side procedure while you retain the client relationship.
What We Need From You
To open a file and prepare your quote, we typically need the following:
- The European patent number and the kind code (B1).
- The date of mention of the grant in the European Patent Bulletin.
- The name and address of the applicant or patent holder.
- The granted text of the patent (description, claims and any drawings).
- Your instructions and contact details as the instructing attorney, if you are foreign counsel.
With these details we can confirm the deadline, calculate the translation volume and issue a fixed quote.
Timeline
A typical engagement runs as follows. First, you send us the patent details and we confirm eligibility and the validation deadline. Second, we issue a fixed quote. On your approval, we prepare the Turkish translation and file the validation request with the Turkish Patent and Trademark Office within the statutory period. We then file the translation within the available window and pay the required official fees. Finally, we confirm completion and keep the file under management for any later actions, such as annual renewal fees needed to maintain the patent in force in Türkiye.
What Happens If You Miss the Deadline
The validation deadlines in Türkiye are strict. If the validation request is not filed within 3 months of the mention of grant, or if the translation is not filed within the further period available, the European patent will not have effect in Türkiye and protection in this territory can be lost.
If a deadline is close, contact us immediately. The sooner we have the file, the more options remain. Acting in good time is always the safest course, and engaging your local Turkish attorney early removes the risk of losing rights to an avoidable administrative lapse.
